Allocation of Parental Responsibilities

Decision-making authority is generally devised into four main categories: education, health and medical, extracurricular activities, and religion.

These important decisions will significantly impact the child. Whether the parents agree to joint decision-making or for one party to have sole decision-making, we are here to help you understand your options and tailor a comprehensive written agreement to best fit the individuals needs of
your family.

Allocation of Parenting Time

While there are common parenting time schedules, we believe the schedule should be set in stone, yet flexible to fit the needs of your child. As such, during mediation, we will encourage you to "try on" your parenting time schedule for a short period before executing your written agreement.

In Illinois, the Courts consider 17 factors when allocating parenting time, and some include: the wishes of the parents and the child depending on maturity, the mental and physical health of all parties, the child's needs, the distance between the parents' residences, domestic violence, and the interaction and interrelationship of the child with his or her parents and siblings.

Child Support & Child Related Expenses

All parents have a duty to provide financial support for their children. Illinois child support obligations are based on an income-shares model which takes into account multiple factors including but not limited to both parents' incomes, number of overnights with the child, number of children, cost of family health insurance, and maintenance/alimony received or paid.

A payor must comply with the child support order. The Court may enforce the child support order through contempt proceedings and potential incarceration.

Child support is for your child, not the other parent.

Maintenance & Spousal Support

Maintenance is money paid from one spouse to another as financial support. The purpose is to assist a spouse to support themselves and live independently during or after divorce.

Maintenance is gender-neutral. There are many factors considered in calculating maintenance including but not limited to the duration of the marriage, standard of living, age and physical condition of both spouses, contributions to household duties and spousal education, agreements such as prenuptial and postnuptial agreements, as well as income and property held by each party.

Modifications

Some court orders may be modified.

A party seeking to modify must file an proper pleading and the Illinois Marriage and Dissolution of Marriage Act requires the party seeking to modify a court order to show a substantial change of circumstances.

In addition, Illinois allows parenting time schedule to be modified whenever the modification would serve the best interests of the child.

Court orders may be modified by agreement of the parties or by court order. We support modification through mediation as each agreement concerning your child or family should be thoughtfully considered and crafted to support your family.
